PUBLIC PROSECUTOR The Court made the following ORDER: This Criminal Petition, under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the petitioner/A1, seeking regular bail, in Crime No.370 of 2024 of Kothapet Police Station, Guntur district. 2. A case has been registered against the petitioner herein and others for the offence punishable under Section 8(c) read 2 with 20(b)(ii)(B), 22(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short ‘the NDPS Act’). 3. Case of the prosecution, in brief, is that on 17.10.2024, at about 10.30 PM, on credible information, the Inspector of Police, Kothapet Police Station, Guntur, along with his staff and mediators, proceeded to Pothurivarithota, 5th Lane, near NTR Statue, Guntur, and found A1 in possession of 59.25 Grams of MDMA (Methelene Dioxy Methamphetamine) and A2 in possession of 07.01 Grams of MDMA, total 66.26 Grams of MDMA. The contraband was seized under cover of a mediators report and a case has been registered against the accused. 4. Heard. Perused the record. 5. The quantity of contraband allegedly seized from the possession of the accused is 66.26 Grams of MDMA, which is a commercial quantity. Learned Assistant Public Prosecutor submits that the petitioner herein/A1 is a drug peddler. He further submits that investigation is at nascent stage and some more accused are to be apprehended. In view of the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner herein. 3 6.
