2 4.4.2024 whereby Claims Tribunal has awarded compensation to the tune of Rs. 71,000/- on account of damages sustained by the car. 3) Facts of the case in a nutshell are that on 29.7.2022, appellant was going from Village Nari to Kurud in car bearing registration No. CG-04-LF-3125. When he reached near Petrol Pump, Village Nari, the offending car bearing registration No. CG-04-NU-2769 dashed the car of appellant. In the accident, car of the appellant was badly damaged. Appellant moved a claim application ; parties led evidence and Claims Tribunal passed the award. 4) Learned counsel for the appellant submits that bill/ estimate was given by the mechanic who repaired the car to the tune of Rs. 1,00,000/-. He further submits that bill (Ex.P/14) generated by Vijay Motor Garage to the tune of Rs. 61,000/- was produced before the Claims Tribunal which has been honored but with regard to rest Rs. 29,000/-, Claims Tribunal rejected the claim of the appellant. He contends that Claims Tribunal has awarded meager amount of Rs. 61,000/- towards damage sustained by the car and Rs. 10,000/- towards injuries sustained by the claimant. He prays to modify the award accordingly. 5) On the other hand, Ms.
Kaur submits that appellant/ claimant has not produced the requisite bills on record, therefore Claims Tribunal has awarded an amount of Rs. 61,000/- towards damage sustained by the car. She further submits that the injuries sustained by the appellant were not severe in nature, therefore
3 Claims Tribunal awarded a sum of Rs. 10,000/- for injuries sustained by the appellant. He contends that Claims Tribunal has passed just and proper compensation, therefore this appeal deserves to be dismissed. 6) Heard learned counsel for the parties and perused the record with utmost circumspection. 7) It appears that appellant has produced the bill issued by Vijay Motor Garage (Ex.P/14) dated 13.2.2023 to the tune of Rs. 61,000/- and Claims Tribunal has honored it. With regard to injuries sustained by the claimant, Claims Tribunal has awarded Rs. 10,000/-. As the appellant himself failed to produce the relevant bills before the Claims Tribunal in order to claim enhanced compensation towards damage sustained by car, this appeal is misconceived. 8) Taking into consideration the above-discussed facts, in the opinion of this Court, no case is made out to interfere with the award impugned.
