This petition is by wife of the convict-Maruti Yallappa Karigar with a prayer to release the convict on general parole for a period of 90 days with liberty to seek extension.
2. Heard the learned counsel Sri. Sirajuddin Ahmed through Video Conference and learned AGA, who is present before the Court. Perused the entire writ petition papers.
3. The above writ petition was called at 11.15 a.m. today and the learned AGA was directed to get instruction from concerned Police Station, as to whether there is marriage of the convict’s son on 10.05.2025. Thereafter, the matter was again called at 12.15 p.m. and the matter is heard.

Learned counsel for the petitioner would submit that the petitioner, wife of the convict, is before this Court with

a prayer to release the convict on parole for a period of 90 days. It is submitted that the convict is convicted in SC No.110/2013 for the offence punishable under Section 302 of IPC. It is further submitted that the mother of the convict is suffering from Typhoid. Further, learned counsel would submit that the marriage of the convict’s son Lakkappa is fixed on 10.5.2025 and in that regard, he invites attention of this Court to Xerox copy of marriage invitation card at Annexure-F. Thus, on the above grounds, he prays for release of the convict on parole for a period of 90 days.
5. In the instant case, mother’s medical ground i.e., Typhoid is not a ground for release of the convict on parole. The convict could be released on emergency parole for son’s/ daughter’s/brother’s/sister’s/grand-son’s or grand-daughter’s marriage. In the instant case, the petitioner has placed on record Annexure-F, invitation card to contend that the convict’s son’s marriage is fixed on 10.5.2025. However, learned AGA has placed on record police report along with a memo dated 8.5.2025, which reads as under:

6. The above police report indicates that no marriage is fixed on 10.5.2025 in the convict’s family. In the above circumstances, the petitioner would not be entitled for relief as sought in the writ petition. Accordingly, writ petition stands rejected. Sd/- (S G PANDIT) JUDGE
