V V SATISH (SC for APEPDCL) The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the action of respondent No.3 in obstructing the petitioner company from harvesting the Eucalyptus crop in the land belonging to the petitioner company despite having interim 2 injunction order dated 11.08.2020, against the respondents therein in C.P. No. 227/241/AMR/2019 at behest of respondent No.4 herein and his henchmen, as illegal, arbitrary, violative of article 14, 19, 21 and 300A of the Constitution of India and devoid of principles of natural justice and consequently direct the respondents No.3 to forthwith not to interfere with the agricultural activities in the petitioners company lands.” 2. Sri P.Ajay Babu, learned Assistant Government Pleader for Home, by way of counter, would submit that, based on the complaint of Respondent No.4 herein, two cases in Crime Nos. 96 and 105 of 2024 have been registered against the Petitioner and others and the Petitioner was called to the Police Station for enquiry. It is further submitted that the Police never interfered in the civil disputes between the parties. 3. Sri Bodduluri Srinivasa Rao, learned counsel for the Petitioner seeks time for getting further instructions. 4. In the light of the submission of the learned Assistant Government Pleader for Home that two crimes have been registered against the Petitioner and regarding the said crimes, the Petitioner was called to the Police Station, no further arguments are necessary in this matter to keep the matter pending. 5. In that view, the Writ Petition is disposed of. However, Police are directed to follow due process of law regarding the crimes which are registered against the Petitioner. Police are further directed to not to interfere in the civil disputes between the parties, except under due process of law. There shall be no order as to costs.
