1. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 26.05.2024 in connection with Crime No. 265/2024 registered at Police Station Seepat, District Bilaspur (C.G.) for the offence under Sections 302, 34 of IPC.
2. The case of the prosecution is that on 26.05.2024, the FIR has been registered against the suspected Shyam Lal and his brother for commission of the murder of the deceased Daulat Ram. The dead body of the deceased was found in tied condition with the tree near village Dagania. On being post- mortem the cause of death was opined as Asphyxia due to strangulation. 2 found by the Police and they have been arrested. From the possession of the present applicants lathi and nylon rope was seized and after their arrested charge-sheet has been filed.

Learned counsel for the applicants would submit that there is no sufficient evidence against the applicants and they have been falsely implicated in the offence. The dead body was found in an open place and there is no eye- witness to the incident and even there is no evidence with respect to the last seen with the deceased. Only on the basis of memorandum statement they have been implicated. The applicants are in jail since 26.05.2024, and final adjudication of the case will take its own time, therefore, they may be enlarged on bail.
4. On the other hand, learned counsel for the State opposes and submitted that the trial of the case is in progress and six witnesses have been examined. There are allegations against the applicants that with respect to the property dispute in which they were in possession, they have committed murder of the deceased by strangulation and tied the dead body in the tree at village Dagania. From their memorandum statement the nylon rope and lathi has been seized from them and looking to the nature of evidence collected during the investigation and progress of trial they are not entitled for bail.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the submissions made by learned counsel for the parties, considering the nature of allegation and the material collected during investigation further considering the gravity of the offence and the manner in which the offence is said to have been committed, the trial is in progress and six witnesses have been examined, I am not inclined to released the applicants on bail, their bail application is rejected.
