GP FOR SERVICES I The Court made the following: 2 THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY W.P.No.30560 of 2025 ORDER: The present Writ Petition is filed to declare the action of the Respondents in not considering the case of the Petitioner for promotion to the post of Superintending Engineer on the ground of pendency of Charge Memorandum vide G.O.Rt.No.1006, MA & UD (Vig.I) Department, dated 23.09.2025 by the Respondent No.1 as illegal and arbitrary. 2. The Petitioner has been working as Executive Engineer from 06.04.2017. It is stated that now he is eligible and qualified for promotion to the post of Superintending Engineer. While so, a Charge Memo stated above was issued to the Petitioner vide G.O.Rt.No.1006, dated 23.09.2025 making certain allegations. 3. It is stated that after serving the above Charge Memo, the Petitioner submitted statement of defence refuting the aforesaid charge and the enquiry is stated to be pending. 4. Learned Counsel for the Petitioner submits that the Petitioner is now due for promotion to the post of Superintending Engineer, but the Respondents are 3 refusing to consider the case of the Petitioner for promotion to the said post on the ground of pendency of disciplinary proceedings. Hence, the present Writ Petition. 5. Having heard the respective submissions, this Court is of the opinion that the case of the Petitioner can be considered for promotion to the post of Superintending Engineer in terms of G.O.Ms.No.257, dated 10.06.1999. 6. The Writ Petition is disposed of with following directions: i) The Respondents are directed to consider the Petitioner’s case for promotion to the Post of Superintending Engineer subject to the Petitioner possessing requisite qualifications in terms of G.O.Ms.No.257, General Administration (Ser.C) Department, dated 10.06.1999. (ii) There shall be no order as to costs.
