COMMON ORDER:
The instant Criminal Petition is filed by the Petitioners under Section 528 of B.N.S.S., 2023 for the following relief:
“ ... to call for records relating to Sessions Case No. 190 of 2022 on the file of the Honourable Special Court SCs & STs (POA) Act cum X Additional District Sessions Judge, Rajamahendravaram and quash the proceeding against the petitioners/ Accused No 1 to 4 herein and pass such ...”

IA.No.2 of 2025 is filed under Section 359(6) read with Section 528 of BNSS, 2023, by the Petitioner/de facto Complainant seeking permission to compromise the matter with the respondents/A.1 to A.4 by quashing the Proceedings in Sessions Case No.190 of 2022 on the file of the Special Court for SCs & STs (PoA) Act-cum-X Additional District Sessions Judge, Rajamahendravaram, against the Accused. 3. IA No.3 of 2025 is filed under Section 359(2) read with 528 BNSS, 2023 requesting to record compromise in Sessions Case No.190 of 2022 on the file of the Special Court for SCs & STs (PoA) Act-cum-X Additional District Sessions Judge, Rajamahendravaram, for the offences under Sections 448, 323, 506 and 109 read with 34 IPC and Sections 3(1)(r), 3(1)(s), 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities)Act, 1989 and quash the proceedings against the Accused. 4. As can be seen from the record, it is the matrimonial dispute. De facto Complainant is the father-in-law of Petitioner No.1/A.1. Petitioner No.1/A.1 and the daughter of de facto complainant/respondent No.2 are husband and wife

respectively. Basing on the complaint given by respondent No.2, the subject crime is registered against the Petitioners/Accused. 4. During the pendency of this Criminal Petition, with the intervention of elders, parties decided to settle the issue amicably and respondent No.2 has no interest to proceed further in the matter and agreed to withdraw the case against Petitioners. 5. Parties are identified by their respective learned counsels on record. Copies of the Aadhar cards of the parties attested by their respective counsel are filed for proper identification. 6. Learned Assistant Public Prosecutor is in attendance. 7. Parties filed compromise petitions as stated supra stating that the matter is compromised between them and also filed a Joint Memo to that effect.
The terms and conditions would reveal that Petitioner No.1/A.1(husband) agreed to pay an amount of Rs.11,00,000/- to the daughter of the (Boddu Devarakonda) towards full and final settlement of permanent alimony for which she agreed for the same vide Demand Draft bearing No.355806, which is to be handed over during the course of hearing of this case. Parties agreed to withdraw all the cases, filed by each other. 8. Respondent No.2 submitted before this Court that she has no issues with the Petitioners and there is no coercion and undue influence for settling the issue with the Petitioners and she received the amount from the Petitioner No.1/A.1. 5
9. Considering the submissions, in the interests of justice, I.A.Nos.2 and 3 of 2025 are allowed. Consequently, this Criminal Petition is allowed and the Proceedings in Sessions Case No.190 of 2022 on the file of the Special Court for SCs & STs (PoA) Act-cum-X Additional District Sessions Judge, Rajamahendravaram, for the offences under Sections 448, 323, 506 and 109 read with 34 IPC and Sections 3(1)(r), 3(1)(s), 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the Petitioners/Accused are hereby quashed.
