1.PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the
2 Petitioner/Accused No.12 for granting of pre-arrest bail in connection with Crime No.251 of 2025 of Badvel Police Station, YSR Kadapa District, registered for the alleged offence punishable under Sections 318(4), 338, 336(3), 340(2), 342(1) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned Counsel for the Petitioner and the learned Assistant Public Prosecutor. 3. The role of the Petitioner has come out based on the confession of Accused No.4. This Court in Crl.P.No.8426/2025 while granting pre-arrest bail to Accused No.11 dismissed the petition of Accused No.10. The allegations by the prosecution are that all the accused created forged documents, DKT pattas and created fake Government seals and seal of the Office of the Tahsildar. There was no reference about the name of the Petitioner in the FIR lodged by the de-facto complainant. 4. Except the confession of Accused No.4 there was no other material. Petitioner/Accused No.12 is standing on the similar footing of Accused No.11. Petitioner is aged about 49 years. He has filed certain medical documents, wherein it has been certified that the Petitioner has been suffering from intestinal problems, and he has been suffering from severe jaundice. 5. Considering the facts and circumstances, the gravity and nature of the allegations levelled the Petitioner/Accused No.12, this Court is inclined to grant pre-arrest bail to the Petitioner/ Accused No.12. 6.
In the result, the Criminal Petition is allowed with the following conditions:
3 i. In the event of arrest of the Petitioner/ Accused No.12, he shall be enlarged on bail subject to he executing a self-bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties for the like sum each to the satisfaction of the arresting police officials. ii. The Petitioner/Accused No.12 shall make himself available for investigation as and when required. iii. The Petitioner/Accused No.12 shall not cause any threat, inducement or promise to the prosecution witnesses. iv. The Petitioner/Accused No.12 shall appear before the Station House Officer concerned once in a week i.e., on every Saturday between 10.00 a.m. and 5.00 p.m., till filing of the charge sheet. v. The Petitioner/Accused No.12 shall not leave the State of Andhra Pradesh limits without the express permission from the Station House Officer concerned. ________________________ Dr.Y.
