This Writ Petition under Article 226 of the Constitution of India is filed for the following relief:
“to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents 1 to 4 in not fixing the petitioners Provisional pension in accordance with Law is illegal and arbitrary, 2) to declare the action of the 2nd respondent in not fixing the petitioners pay Scale, as per the revised pay scales of 1996 and 2006 for fixation of pension required to be paid

to the petitioner is illegal, arbitrary and contravention of the G.O.Rt.No.767 dated 19-10-2011 issued by the 1st respondent, consequently direct the respondents to pay the Provisional pension in accordance with the pension rules.”

Today, when the matter is taken up for hearing, Ms.Kamireddy Divya, learned counsel representing Sri N.Subba Rao, learned counsel for the petitioner would submit that in view of the subsequent events taken place in the lis, the cause in the Writ Petition does not survive for further adjudication and the Writ Petition has become infructuous.
3. Recording the submission made by learned counsel appearing on behalf of the petitioner, the Writ Petition is dismissed as infructuous. There shall be no orders as to costs.
