GP FOR HOME (AP) 3 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 33204 of 2023 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer: “…to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent Nos.5 and 6 in interfering into the peaceful life and liberty of the petitioner and interfering into the civil disputes and calling the petitioner to the police station and threatening him to settle the disputes with the respondent No.7 is highly illegal, arbitrary, unconstitutional, unjust, violation of principles of natural justice and also in violation of Articles 14,15 and 21 of the Constitution of India and consequently direct respondent Nos.5 and 6 to not interfere into the peaceful life and liberty of the petitioner and not to interfere into the civil disputes and not to call the petitioner to the police station and not to threaten him to settle the disputes with the respondent No.7 and pass.…” 2. Sri V.Farook, learned Assistant Government Pleader for Home, on written instructions, would submit that basing on the complaint of one Veeramalla Koteswara Rao/7th respondent, through Spandana, the petitioner was called to the police station to enquire into the matter and no crime has been registered against the petitioner, since the subject matter is civil in nature. He would further submit that the police are not interfering in the civil disputes between the parties. 4 4. Recording the same, this Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. The police are further directed not to call the petitioner to the police station in absence of any crime against him. No costs.
