NIMMAGADDA REVATHI The Court made the following: ORAL ORDER: Heard Sri P. Vara Prasada Rao, learned Counsel representing Sri V. Raja Monohar, learned Counsel for the Civil Revision Petitioner and Smt. Nimmagadda Revathi, learned Counsel for the Respondents. 2. It is the case of the Petitioner herein that the Petitioner is the Plaintiff. She has filed a Suit for Temporary Injunction. The Trial Court had granted an Interim Injunction under Order XXXIX Rule 1 of the Code of Civil Procedure, 1908. The Defendants filed C.M.A.No.02 of 2019 on the file of the Special Judge for Trial Cases under the SCs & STs (POA) Act-cum-IV Additional District Judge, Srikakulam, challenging the Order passed by the Additional Civil Judge (Senior Division), Srikakulam, in I.A.No.676 of 2018 in O.S. No. 224 of 2018 dated 27.12.2018. 3. The Special Judge for Trial of Cases under the SCs & STs (POA) Act- cum-IV Additional District Judge, Srikakulam, by Order dated 22.01.2025, was pleased to set aside the Order of the Trial Court dated 27.12.2018 after having considered the Reports submitted by the Advocate Commissioner. Admittedly, the Advocate Commissioner was appointed by the Trial Court, and the Report submitted by the Advocate Commissioner was before the IV Additional District Judge, Srikakulam. Upon considering the said Report, the IV Additional District Judge, Srikakulam, has set aside the Order dated 27.12.2018 and indicated that fresh Orders may be passed after considering the Advocate Commissioner’s Report. 4. Having considered these facts, this Court is of the view that there is no merit in the present Civil Revision Petition. 5. Accordingly, this Civil Revision Petition is dismissed. No order as to costs. 3 6. However, there shall be a direction to all the parties to maintain Status quo obtaining as on today. The Plaintiff shall not undertake any construction during the pendency of I.A.No.676 of 2018 in O.S.No.224 of 2018. The learned Additional Civil Judge (Senior Division), Srikakulam, shall dispose of the said Interlocutory Application as expeditiously as possible, in any case within eight (08) weeks from today. 7. There shall be a further direction to both parties to cooperate with the learned Additional Civil Judge (Senior Division), Srikakulam, for early disposal of the Interlocutory Application in terms of the directions of the Special Judge for Trial of Cases under the SCs & STs (POA) Act-cum-IV Additional District Judge, Srikakulam, in C.M.A.No.02 of 2019. 8. It is clarified that this Court has not expressed anything on merit and the learned Additional Civil Judge (Senior Division), Srikakulam, shall dispose of the Interlocutory Application on its own merits in accordance with law. 9.
