Both in the draft plaint and at paragraph 5 of the affidavit in support of this application, the applicant has stated that a part of the cause of action arose in Chennai where the intending plaintiff and defendant had entered into a sale agreement dated 01.01.2005 and where multiple invoices were raised on the defendant. It is also stated therein that the Cargo was exported by the plaintiff to Italy from the Chennai Port. 3. Upon examining the draft plaint and the affidavit in support of this application, it is clear that at least a part of the cause of action arose within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to the applicant to sue the respondent before this Court.
