For the purpose of excavation of 15-B Major Distributory in Block No.lS-B of Telugu Ganga Project, different extents of lands of the respondents in various survey numbers of Beeravolu village were acquired, pursuant to a Notification dated 20.03.2005 issued under Section 4(1) of the Land Acquisition Act, 1894 (hereinafter referred to as the ‘Act’). The Land Acquisition Officer, after conducting enquiry, vide Award No.11/2005 dated 10.08.2005 fixed the market value @ Rs.35,000/- per acre for lands under Category-1 for Dry lands and Rs.45,000/- per acre for lands under Category-ll for irrigated dry lands. The respondents/claimants while compensation under protest sought reference under Section 18 of the Act. receiving the 4. Before the Reference Court, they claimed an amount of Rs.2,00,000/- per acre and in support of their case. examined P.Ws.1 (claimant in O.P.No.209 of 2012) to P.W.3 and got marked Exs.AI- Certified Copy of the Sale Deed dated 09.02.2004 and Ex.A2-Thimmapuram Mandal Map issued by Special Deputy Collector (L.A.), S.R.B.C. Nandyal and Ex.A3-Sirivel Mandal Map. On behalf of the Referring Officer, no oral evidence was adduced. Attested Copy of the Award No. 11/2005, dated 10.08.2005 i respect of the lands in question was marked as Ex.BI. in 5. The Reference Court, after examining the oral and documentary evidence, enhanced the compensation to Rs. 1,10,000/- per acre. 6. Learned Government Pleader, vehemently contends that enhancement of the compensation by the Reference Court is without any valid basis. He submits that the respondents/claimants have the not adduced any 3 cogent evidence to substantiate their claim for enhancement of the compensation. He argues that Ex.A1-Sale transaction dated 09.02.2004 is in respect of the lands situated in a different village i.e., Gajulapalle, whereas the acquired lands are situated in Beeravolu Village, Rudravaram Mandal. Further, that a small extent of Ac.0.68 cents was sold and the learned Reference Court went wrong in taking the said transaction into consideration for the purpose of fixing the market value. Making the said submissions urged for allowing the appeals. , he 7. This Court has considered the submissions made and appreciation of the same, the point that arises for consideration is ; Whether the Common Order under challenge warrants interference by this Court in the facts and circumstances of the case? At the outset, it may be appropriate to mention that hundreds of acres of land situated in different villages of Kurnool District were acquired for the purpose of the Telugu Ganga Project. Most of these villages contiguous and nature of the land in most of these villages is similar. Be that as it may. on an 8. are 9. As noted earlier, seeking enhancement of the compensation in respect of the subject matter lands, the respondents/claimants got examined P.W.1 (claimant in L.A.O.P.No.209 of 2012) to P.W.3. They relied dated 09.02.2004 which is in respect of lands situated in the neighbouring Gajulapalli Village, wherein an extent of Ac.0.68 cents Rs.68,000/- which works out to Rs. 1,00,000/- per acre. P.W.1 filed affidavit in claim statement, dated 09.02.2004(Ex.A1) P.W.2, the Mandal his evidence stated that the villages viz., Govindapalle, Gangavaram, Boilakuntia, Mothukulapalle and Isukapalle are within his jurisdiction and that they have similar crop pattern and productivity. He further deposed on Ex.A1 was sold for lieu of chief examination supporting the contents of the P.W.3, one of the attestors to the Sale Deed supported the version of P.W.1. Most importantly Agricultural Officer in Mahadevapuram, Gudampadu, Chennur, that the nature of the lands and crop pattern is also similar, that Beeravolu village is at a distance of 10 kms., from Gajulapalle village. Ex.AI is in respect of the lands situated in GajulapaJle village. Nothing contra could be elicited in the cross examination of P.Ws.1 to 3 that Ex.AI dated 09.02.2004 is not genuine, brought into existence for the purpose of boosting the claim artificially. Hence, the same can be safely relied for the purpose of fixing the market value and the submission of the learned Government Pleader with reference to the sale statistics/transactions unless exhibited before the ReferenceCourt, cannot be appreciated. (See: Chimanlal Hargovinddas vs. Special Land Acquisition Officer, Poona and Another^ The learned Reference Court by taking into consideration the evidence on record more particularly Ex.AI, fixed the market value as the lands in question and the lands under Ex.AI transaction are situate in the adjoining Villages. In G.M., O.N.G.C. Ltd., v. Sendhabhai Vastram Patel^, the Hon’ble Supreme Court inter alia held that instances of sale of similar lands situate in the same village or neighbouring villages can be taken for determination of the market value. Therefore, the contention advanced by the learned Government Pleader is rejected. In the present case, the lands are acquired for Telugu Ganga Project and there is a time gap of more than 1 year between the Ex.AI sale deed dated 09.02.2004 and the Section 4(1) Notification dated 20.03.2005. The Reference Court has taken into consideration 1 year time gap. Further referring to Om Prakash vs. Union of India^, value appreciation @ 10% annum was taken into account, though it may be taken up to 12% If the same is applied, the market value would be more. However, no cross objections were filed. Fixing uniform rate in view of the nature of the land cannot be viewed as unjust or unreasonable. 10. 11. per per annum. Considering the matter in its entirety, this Court is of the considered opinion that the enhancement of compensation by the Reference Court was based on the material on record, supported by cogent reasons, not on higher side and warrants no interference by this Court.
