1. The application under Section 378(3) of Cr.P.C. has been filed seeking for grant to leave to appeal against the
judgment of acquittal dated 24.12.2022 passed by learned Special Judge (Electricity Act, 2003), Surajpur, District - Surajpur (C.G.) in Special Criminal Case No. 02/2022 whereby respondents have been acquitted for the charge under Section 136 of the Electricity Act, 2003 in connection with Crime No. 220/2021, registered at Police Station Ramanujnagar, District – Surajpur (C.G.).
2. Considering the facts and circumstances of the case, this Court is of the opinion that arguable points have been raised by the petitioner for grant of leave to appeal.
3. Accordingly, the application seeking leave to appeal is allowed. Leave as prayed for is granted.
4. Let this CRMP now be registered as an Acquittal Appeal and issue notice to the respondents as per rules.
