Present Writ Petition has been filed under Article 227 of the Constitution of India with the following prayers :-
“(i) Issue a writ, order or direction, directing the court of learned Civil Judge (Sr. Div.), Nainital to decide & conclude the proceedings of civil suit no. 95/2022 'Govind Ballabh Pandey V/s Sandeep Srivastava & others' (Annexure No. 1 to this writ petition) as expeditiously as possible, preferably within a time period of six months, or within the stipulated time granted by this Hon'ble Court, which this Hon'ble Court may deem fit and proper in the present circumstances of the case. (ii) Pass such other or further orders in favour of petitioners, which this Hon'ble Court may deem, fit and proper in the facts and circumstances of the case. (iii) Award the cost of petition to the
petitioners.”

2. Mr. Sagar Kothari, Advocate, has requested to decide the present writ petition directing the concerned court to expedite the hearing of the Civil Suit No.95 of 2022 and decide the same as expeditiously as possible.

In the facts and circumstances of the case, the Trial Court will endeavour to decide the Civil Suit No.95 of 2022 as per law, as expeditiously as possible and without granting any unnecessary adjournment to either of the parties.

The present writ petition is disposed of in the aforesaid terms.

It is made clear that this Court has not expressed any opinion on the merit of the case.
