The present writ petition has been filed seeking directions to the respondents no.1 to 3 to take action against the illegal construction carried out by the respondent no.4 in the property bearing No. H-16/904, Sangam Vihar, New Delhi. 2. Notice in the petition was issued on 10th December, 2025. 3. Status report is stated to have been filed on behalf of the respondent/MCD on 1st July, 2026. 3.1 However, the same is not on record. 3.2 A copy of the status report has been handed over in Court and the same is taken on record. 4. Subsequently, since the property was occupied, a vacation notice under Section 349 of the DMC Act was issued on 1st July, 2026. 5. None appears on behalf of the petitioner. 6. None had appeared on behalf of the petitioner on the last date of hearing as well, i.e. 10th April, 2026. 7. Noting the aforesaid submissions made on behalf of the respondent/MCD, the present writ petition is disposed of while directing the respondent/MCD to take further action in accordance with law. 8. The SHO, P.S. Sangam Vihar shall keep strict watch and ward over the subject property to ensure that no further construction is carried out in the subject property. 9. All rights, contentions and legal remedies of the owner/occupier/private respondents are kept open. 10. Pending application stands closed.
