(Oral) The applicant is in judicial custody in FIR No.207 of 2019, dated 05.11.2019, under Section 302 IPC, Police Station Premnagar, District Dehradun. He has sought his release on bail. 2. It is second bail application of the applicant. His first bail application has already been rejected on 19.03.2024. 3. Heard learned counsel for the parties and perused the record. 4. Learned counsel for the applicant submits that the applicant is in custody since 18.09.2020; there are 16 witnesses, out of which, only 11 witnesses have been examined till date and there appears to be less chances of trial being concluded in the near future. 5. The factual narration is not denied by learned State Counsel. 6. The applicant is in custody for more than five years now. 2 7. Having considered the time of which the applicant is in custody and the time that may be taken in concluding the trial, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail. 8. The bail application is allowed. 9. Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
