2. The petitioner has filed this application for quashing of the order dated 24.05.2023 passed by the Court of Sri Pradip Kumar Choubey, learned Special Judge, N.D.P.S. Act, Palamau, whereby and wherein, the learned Special Judge, N.D.P.S. Act, Palamau has directed for issuance of non- bailable warrant of arrest against the petitioner in connection with N.D.P.S. Case No. 12/2022 arising out of Chainpur P.S. Case No. 214/2022, for the offences registered under Sections 20 & 22 of the N.D.P.S. Act. 3 . It was submitted that the petitioner was on bail during the trial. It was further submitted that on 24.05.2023 the petitioner was represented through his lawyer but his representation was cancelled and the learned Trial Court
directed for issuance of non-bailable warrant of arrest against him.
4. Learned A.P.P. has submitted that on 24.05.2023, this case was fixed for framing of charge.
5. In view of the submissions made above, the impugned order dated 24.05.2023 passed by learned Special Judge, N.D.P.S. Act, Palamau for issuance of non-bailable warrant of arrest against the petitioner is quashed.
6. This Criminal Miscellaneous Petition is allowed. Pending I.A., if any, stands disposed of.
7. The petitioner is directed to appear before the learned Trial Court within two weeks from the date of receipt of this order.
