ORAL ORDER
(PER: THE HON'BLE MR. JUSTICE SURAJ GOVINDARAJ)
1. The petitioner is before this Court seeking for the following reliefs: a. Issue a writ of certiorari against application no. 112/2015 dated. 02-12-2021 passed by additional Labour Court Hubballi, produced as Annexure-A.
b. Issue an order, direction or writ as this Hon’ble Court deems fit and necessary. 2. It is submitted that this matter has been amicably settled between the parties. Pursuant thereto, a joint memo of settlement has been filed, recording the terms of the compromise, which reads as under: Compromise petition
1. The Petitioner Corporation has challenged the legality and correctness of the orders in KID NO. 63/2015 passed by Principal District and Sessions Judge and Labour Court Haveri. The workman/ Respondent was Driver Cum Conductor in the Petitioner/Corporation and he was dismissed from service vide order dated 16-04-2015 in a pilferage case. The Respondent/workman have challenged the said dismissal order in KID No. 63/2015 before the Labour Court, Haveri. Meanwhile the workman

also filed an appeal before Appellant Authority challenging the dismissal order. Pursuant to the same the Appellant Authority has set aside the dismissal order and passed an order of reinstating the workman without continuity of service and without consequential benefits by withholding 2 annual increments permanently, and treating suspension period as not on duty and not entitled for any monetary benefits for the said period vide its order dated. 26-08-
2022. 2. Further, the Labour Court vide its order dated 29-09-2022 directed to reinstate the workman into service, with continuity of service without backwages and other consequential benefits from the date of dismissal from his service till the date of award or reinstatement, if any whichever is earlier. Being aggrieved with the said orders, the Petitioner/Corporation filed WP.No.102755/2024 before the Hon'ble High Court. 3. On detailed discussions both the parties agreed to accept the orders of appellate authority dated 26-08-2022 and the workman undertake that he will not execute the order passed in KID No 63/2015 and he is bound by the order of the Appellant Authority. 4.
That the contents of this joint memo are read over and explained to the Respondent/Workman in Kannada Language and same are true and correct and binding on the both parties. 5. The petitioner/Corporation and Respondent/ Workman on their free wish and will agreeing for the terms and conditions of this joint memo have signed the joint memo. - 4 -

WHEREFORE, both the parties pray that, the above matters may be disposed of in terms of the aforesaid joint settlement, in the ends of justice and equity. 3. Accepting the joint memo of settlement, the petition is
disposed of in accordance with the settlement reached between the parties.
