1. The present writ petition has been filed seeking following relief:- (I) That this Hon’ble Court may kindly be pleased to call the records for kind perusal of the Hon’ble Court. (ii) That this Hon’ble Court may kindly be pleased to issue a writ in the nature of Certiorari and quash the order dated 28.08.2025 (Annexure P/1) passed by respondent No. 2. order dated 28.08.2025 (Annexure P/1) passed by respondent No. 2, till the pendency of the instant writ petition. (iv) This Hon'ble Court may be pleased to pass any other order(s) as it deems fit, in the interest of justice.
2. By way of the present writ petition, the petitioner purchased a vehicle TATA NEXON on loan which has been registered as CG-15-EA-3371 in the name of petitioner. It is alleged that, the subjected vehicle was used in transportation of English liquor upon which a Crime No.333/2025 has been registered at Excise Circle, Ambikapur, against Daya Sahu, and aforesaid vehicle was seized by respondent no.4 and after investigation the chargsheet has been filed and now the trial is pending before Judicial Magistrate First Class, Ambikpaur, District-Surguja (C.G.). The petitioner filed an application for supurdnama before the respondent no.2 which was allowed vide order dated- 27.05.2025 and the subjected vehicle handed over to the petitioner. But surprisingly, vide impugned order the subjected vehicle confiscated and also ordered will auction and will deposit the amount received after the auction in the respective account. Hence, this petition.

Learned counsel for the respondent-State opposed the submission made by the learned counsel for petitioner.
4. I have heard learned counsel for the parties and perused the records with utmost circumspection.
5. The respondent No. 2 on 27.05.2025 has allowed the application and passed an order and subjected vehicle has been given to petitioner on supurdnama. 6. Perusal of the records would show that the criminal case arising out of the crime no. 333/2025 is still pending before the CJM Ambikapur. If any adverse order or conviction order is passed by the CJM Ambikapur against the petitioner, then the Collector Surguja has right to pass confiscation order against the vehicle CG-15-EA-3371 in accordance with law. Therefore, this Court is of the opinion that the impugned order passed by the Collector Surguja is not sustainable. As such, the impugned order dated 28.08.2025 passed by the Collector Surguja is hereby set aside.
7. Accordingly, the present writ petition stands allowed.
