Be that as it may, following the earlier view expressed by us in WP.No.15780 of 2024, the order of assessment, dated 24.04.2024 is set aside. The matter is remanded back to respondent No.3 to pass a fresh order of assessment keeping in view the provisions of Section 16(5) of CGST Act, which came into effect from 27.09.2024. 2 HCJ & RRR, J WP_8404_2024 The Writ Petition is, accordingly, allowed.
