.Heard Mr. SA Hussain, learned counsel appearing for the petitioner as well as Mr. D. P. Goswami, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioner, Smti. Balo Adam has prayed for releasing her on regular bail, who is facing trial u/s 371 of the Indian Penal Code in Sessions Case No. 210(NL)/2024 pending in the court of learned Sessions Judge, Lakhimpur, North Lakhimpur. The allegation brought against the petitioner in the FIR is that she had taken three women, namely, Anita Harijan, aged about 45 years, Cragno Vengra, aged about 55 years and Dipti Vengra, aged about 50 years to Arunachal Pradesh for work. 4. Subsequent to that, information were received about the whereabouts of the three women. When the informant enquired about those three women, the present petitioner stated that she did not have any knowledge about the said women. 5. In the meantime, police recovered all the three women. In the police report, it has been stated that though the women were working for a year at Arunachal Pradesh, they were not paid any salaries. 6. Ultimately, police filed a charge-sheet against the present petitioner u/s 371 of the Indian Penal Code. The trial court framed the charge against her u/s 371 of the Indian Penal Code. 7. I have considered the submissions made by the learned counsels of both sides. 8. Mr. Goswami has submitted that the scanned copy of the LCR would be required. 9. After considering the submissions made by the learned counsel of both sides, this Court is of the opinion that at this stage, without referring to the merit of the case, the petitioner no longer deserves to be detained in custody. 10. Accordingly, the bail application of the petitioner is allowed. 11.
It is hereby directed that the petitioner, Smti. Balo Adam, who is facing trial in Sessions Case No. 210(NL)/2024 pending in the court of learned Sessions Judge, Lakhimpur, North Lakhimpur, shall be released on bail of ₹ 25,000/- with a surety of like amount to the satisfaction of the learned Sessions Judge, Lakhimpur, North Lakhimpur. 12. The petitioner shall regularly appear before the trial court. If she appear before the trial court without showing any satisfactory reason, the learned trial court shall have the liberty to take all steps to procure her attendance. With the aforesaid direction, the bail application stands disposed of. JUDGE Comparing Assistant
