This writ petition has been filed seeking following relief :- "Issue a writ, order or direction in the nature of certiorari calling for the record and quashing the Order dated 22.01.2025 passed by the Sub Divisional Magistrate/Assistant Collector, Tahsil Nakud, District Saharanpur (Annexure No. 9 to the Writ Petition). 2 Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to forthwith conduct 'paimaish and demarcate boundaries of kabristan / graveyard bearing khasra no. 200/2, area 0.728. hectare, Ambehta, Tahsil Nakud, District Saharanpur. 3) Issue a writ, order or direction in the nature of mandamus directing the respondent authorities to remove illegal encroachment/construction from kabristan / graveyard land bearing khasra no. 200/2, area 0.728 hectare, Ambehta, Tahsil Nakud, District Saharanpur and further to ensure peaceful and uninterrupted use of the kabristan/graveyard land for burial of dead. persons and related customary rituals." 3. A preliminary objection has been raised by learned Standing Counsel that against the order impugned, petitioner has remedy of filing an appeal under the relevant provisions of U.P. Revenue Code, 2006. 4. In view of the same, I am not inclined to interfere with the matter. 5. Accordingly, this writ petition stands disposed of with liberty to the petitioner to avail the remedy, as available to him, under the law. 6. Certified copy, if any, be returned to learned counsel for the petitioner after retaining xerox copy of the same on record.
