The present Special Leave to Appeal has been filed seeking leave to appeal against the judgment and order dated 28.01.2025, passed by the learned Judicial Magistrate/Ist Additional Civil Judge, Haridwar in Complaint Case No. 1083 of 2020, titled “Harish Malhotra vs. Anuj”, under Section 138 of the Negotiable Instruments Act, 1881, whereby the learned Judicial Magistrate/Ist Additional Civil Judge, Haridwar has acquitted Respondent No. 2.
4. As per the office report, notices have been personally served upon the Respondent; hence, service is sufficient. However, no one has appeared on his behalf.
5. Heard on the Special Leave to Appeal.
6. Grounds are sufficient to grant leave to appeal. Accordingly, the leave to appeal is allowed.
7. The Trial Court Record has been received and taken on record.
8. The paper book has also been prepared. The Registry is directed to furnish copies of the paper book to the learned counsel for the parties, in accordance with the Rules.
9. Objections, if any, be filed by the Respondent.
