GP FOR REVENUE 3 THE HONOURABLE SRI JUSTICE TARLADA RAJASEKHAR RAO WRIT PETITION No.27013 of 2025 ORDER:- The present Writ Petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue a writ of mandamus or any other appropriate writ order or direction declaring the inaction of the respondent Nos.2 to 6 in conducting the survey in spite of issuing survey notice dt.03.08.2025 under section 15 (1) and 22 of AP Survey and Boundaries Act, 1923 in respect of petitioners lands in Sy.No.199-1 to an extent of Ac.No.0.60 cents, in Sy.No.191-1 to an extent of Ac.No.0.31 cents, in Sy.No.191-2 to an extent of Ac.No.1.21 cents, in Sy.No.192-1B to an extent of Ac.No.0.35 cents, in Sy.No.200-1 to an extent of Ac.No.0.41 cents, in Sy.No.200-2 to an extent of Ac.No.3.65 cents, in Sy.No.203-1 to an extent of Ac.No.1.30 cents, and in Sy.No.204-1 to an extent of Ac.No.0.13 cents situated at Podaralla Village, Bukkarayasamudram Mandal, Anantapuram District is illegal, arbitrary, in contrary to AP Survey and Boundaries Act, 1923 and consequently direct the respondents to conduct survey and fix boundaries in respect of the petitioners lands in Sy.No.199-1 to an extent of Ac.No.0.60 cents, in Sy.No.191-1 to an extent of Ac.No.0.31 cents, in Sy.No.191-2 to an extent of Ac.No.1.21 cents, in Sy.No.192-1B to an extent of Ac.No.0.35 cents, in Sy.No.200-1 to an extent of Ac.No.0.41 cents, in Sy.No.200-2 to an extent of Ac.No.3.65 cents, in Sy.No.203-1 to an extent of Ac.No.1.30 cents, and in Sy.No.204-1 to an extent of Ac.No.0.13 cents situated at Podaralla Village, Bukkarayasamudram Mandal, Anantapuram District and to pass such other order.…” 2. The grievance of the petitioner in the present writ petition is that despite issuance of a survey notice dt.03.08.2025 under Section 15(1) and 22 of the A.P.Survey and Boundaries Act, 1923 by respondents, no steps have been taken to conduct the survey. Hence, petitioner has been constrained to file present writ petition, seeking a direction to the respondents to conduct survey and fix boundaries in respect of the petitioner’s lands. 4 3. Heard Sri N.Aswartha Narayana, learned counsel for petitioner and learned Assistant Government Pleader for Revenue for respondents. 4. Learned counsel for petitioner submits that as survey notice dated 03.08.2025 has already been issued, it would suffice if a direction be given to the respondents to conduct the survey and fix boundaries as expeditiously as possible. 5. Learned Assistant Government Pleader submits that survey will be conducted and boundaries will be fixed in accordance with law. 6. Hence, with the consent of both the learned counsel, the present Writ Petition is disposed of at the admission stage, directing the respondents to conduct survey, in pursuance of the notice dated 03.08.2025, as expeditiously as possible, and in any case, not later than four (04) weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
