The applicant has preferred this First Bail Application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Crime No.34/2025, registered at Police Station: Directorate of Revenue Intelligence (DRI) Raipur, District- Raipur (C.G.) for the offences punishable under Sections 8(C), 20(b)(ii-C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act. As per the prosecution story, is that on 19.08.2025 the applicant with other co-accused person were illegally transporting 39.833 Kgs of Ganja by concealing it in vehicle bearing registration number CG-10, NC 6633 on which police station Directorate of Revenue Intelligence (DRI) Raipur lodged FIR and arrested the applicant and other co-accused. There is no option available on web portal of Directorate of Revenue Intelligence for F.I.R and no mechanism available on internet for fetching the FIR registered by the Directorate of Revenue Intelligence. Therefore, due to unavailability of F.I.R it could not be annexed in the present bail application. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the present case. It is further submitted that the applicant is a student of Computer Operator and Programming at the ITI, and to meet his basic daily needs, he works as a driver. He was allegedly called by the co-accused to drive the concerned vehicle on a daily basis. The applicant had no knowledge about the illegal substance present in the vehicle. It is further submitted that there was no direct recovery from the applicant's person or belongings. Moreover, the charge-sheet has not yet been filed, and the applicant has no previous criminal antecedents. The applicant has been in jail since
19.08.2025.
As the conclusion of the trial is likely to take some time, he prays for the grant of bail. 4. On the other hand, the learned counsel for the non-applicant opposes the bail application and submits that the applicant, along with the other co-accused, was illegally transporting 39.833
3 kilograms of Ganja by concealing it in a vehicle bearing registration number CG-10-NC-6633, which is much more than the commercial quantity. Hence, the bail application is liable to be dismissed. 5. I have heard learned counsel for the parties and perused the material available on record. 6. Taking into consideration the fact that the applicant, along with the other co-accused, was illegally transporting 39.833 kilograms of Ganja by concealing it in a vehicle bearing registration number CG-10-NC-6633, which is much more than the commercial quantity, and the applicant has failed to give any explanation for the same and it cannot be said to be a case of false implication, accordingly, the bail application of applicant – Akash Kumar Yadav involved in Crime No.34/2025, registered at Police Station: Directorate of Revenue Intelligence (DRI) Raipur, District- Raipur (C.G.) for the offences punishable under Sections 8(C), 20(b)(ii-C) and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985, for short, the NDPS Act, is rejected at this stage. 7. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 8. The Office is directed to provide a certified copy of this order to the trial Court for necessary information and compliance forthwith. Sd/-
