GP FOR HOME The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: 2 “.... to issue a writ. Order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the high-handed acts of the Respondent No.6 as he mis-used his official power by interfering in civil dispute while an Appeal is pending in A.S.No.69/2013 on the file of IX-Additional District judge of Chittoor, arised out of the judgement and decree in O.S.No.51/2004, regarding partition of our property and the said Appeal was filed by my father M.D. Ramachandran against the M.D. Vedanayaki and after demise the 7th respondent added as a party to the said Appeal and at her instance the 6th respondent called the petitioner to his police station through his staff by their land phone numbers 918572 and 234222 and also from his cell phone number 949170457 on 19-06- 2024 P.M. and also on 21-06-2024 at about 11.30 A.M. and threatened the petitioner with dire-consequences unless the petitioner part with their property in favour of the 7th respondent was illegal, irregular, arbitrary and violation of Articles 14,19,21 and 300-A of the Constitution of India and consequently direct the Respondent Nos.2to4 to conduct enquiry on the representation of the petitioner dated 27-06-2024 and take disciplinary action against the 6th Respondent for his illegal acts, in the interest of justice, and pass such.” 2. Heard Sri Basha Shaik, learned counsel for the petitioner and Sri Ajay Babu, learned Assistant Government Pleader for Home. 3. Learned counsel for the petitioner would submit that the police are interfering in the civil disputes between the parties. 4. Learned Assistant Government Pleader for Home would submit that the police are not interfering in the civil disputes between the parties. 5. Considering the submissions made, the Writ Petition is disposed of. However, the police are directed not to interfere in the civil disputes between the parties except under due process of law. There shall be no order as to costs.
