Neutral Citation No. - 2025:AHC:141059 Court No. - 9 Case :- CIVIL REVISION No. - 75 of 2017 Revisionist :- Shia Central Board Of Waqf Lucknow Opposite Party :- Akbar Ali And 26 Others Counsel for Revisionist :- Punit Kumar Gupta,S.M. Iqbal Hasan Counsel for Opposite Party :- Ashish Kumar Dwivedi Hon'ble Manish Kumar Nigam,J. 1. Heard learned counsel for the parties and perused the record. 2. This revision has been filed challenging the order dated 28.9.2016 by which the application filed by the opposite parties before the Waqf Tribunal was allowed and the order dated 13.6.2002 passed by the U.P. Shia Central Waqf Board was set aside. By order dated 13.6.2002, the Chief Executive Officer of the Waqf Board passed an order mentioning therein that land in dispute i.e. Khasra Nos. 947, 949, 950, 965, 969, 968, 850, 851, 866, 869, 870, 950, 839, 898, 901, 902 and 857, situated at village Abdullahpur, Meerut is registered as Waqf property but has not been recorded in the revenue record as such and has requested the District Magistrate for making relevant revenue entries in the revenue records so that Waqf property may be secured. The said order has been set aside by the order impugned in the present writ petition. 3. Learned counsel for the opposite parties relied upon the order passed by the Waqf Board on the application filed by the opposite parties by which the property in dispute has been deleted from the register of Waqf by the order passed by the Chairman dated 29.10.2024. 4. Since the property in dispute is not recorded as Waqf in the Waqf register and the entries have been directed to be deleted, no cause of action survives in the present writ petition. Therefore, the present revision is dismissed accordingly. Order Date :- 18.8.2025 Rishabh [Manish Kumar Nigam, J.] Digitally signed by :- RISHABH KUMAR High Court of Judicature at Allahabad
