This writ petition has been filed seeking a direction upon respondent no.3/Sub-Divisional Magistrate, Salempur, Deoria for complying the order passed under Section 24 of the U.P. Revenue Code, 2006 on 31.10.2018. According to petitioner's counsel, the said order has not been carried out, and the demarcation proceedings have also not been completed. As more than seven years have elapsed and the order passed under Section 24 of the U.P. Revenue Code, 2006 has not been complied with, no useful purpose would be served in keeping the matter pending or calling for counter affidavit. The petitioner is directed to move an application before respondent no.3- Sub-Divisional Magistrate, Salempur, Deoria within 15 days from today. In case, such application is moved by the petitioner within aforesaid period, the respondent no.3- Sub Divisional Magistrate, Salempur, Deoria shall proceed with the said application and comply the order dated 31.10.2018 within a period of next one month, in case there is no legal impediment, strictly in accordance with law. After the order was dictated, learned Standing Counsel has submitted that a restoration application has been moved, which is pending consideration. In case, the said restoration application is pending consideration, the officer concerned shall proceed with the said application and decide the same first strictly in accordance with law.
