Petitioner has filed this writ petition seeking following reliefs: “10.1 That, this Hon'ble Court may kindly be pleased to direct the respondent State to formally acquire the subject land with Kh. No. 1653/1 area 0.266 Hect., situated in village Tedesara, P.H.N.-63, R.N.M.- Tedesara, Tahsil and District Rajnandgaon (C.G.), and disburse the compensation amount to the petitioner along with interest, within a stipulated time frame, and/or 10.2 Direct the Respondent authorities to decide the pending representation dated 30.06.2025 (Annexure P/1), within a stipulated time frame, in accordance with law, and/or 10.3 That, this Hon'ble Court may be pleased to pass any other relief that this Hon'ble Court may deem fit and proper. ” 2. Learned counsel for the petitioner submits that while construction of road under Bharat Mala Project, road is constructed over land of petitioner after demolishing superstructure constructed over it. However, land owned by petitioner over which superstructure was erected was not made part of acquisition proceeding. Therefore, the petitioner submitted a representation before respondent No.3 raising grievance as raised in this writ petition, however, said representation/application is not considered and it is still pending consideration and, therefore, direction be issued to respondent No.3 to take decision on representation of petitioner within specified time. 3 / 3 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for the petitioner he is having no objection. If representation submitted by the petitioner is still pending consideration, same will be considered and appropriate order in accordance with law will be passed. 4. In view of submissions of learned counsel for respective parties, nature of grievance raised, this writ petition at this stage is disposed off directing respondent No.3 to take decision on pending representation dated 20.01.2025 and 27.01.2025 in accordance with law, expeditiously, preferably within a further period of 2 months from the date of receipt of copy of this order. 5. It is made clear that this Court has not expressed any opinion on merit of claim of petitioner and it will be open for respondent No.3 to take decision on claim of petitioner on its own merits after verifying the facts.
