GP FOR SOCIAL WELFARE The Court made the following: 3 THE HONOURABLE SRI JUSTICE D.RAMESH WRIT PETITION No.34224 of 2025 ORDER: This writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “….to issue a Writ order or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the Respondents more particularly Respondents No.5 and 6 and their staff in trying to interfere the peaceful possession and enjoyment of the petitioners respective land of an extent of Ac.12.05 cents in Survey Nos.49, 50, 51 (1st petitioner), an extent of Ac.5.01 cents in Survey Nos.49, 51 (2nd petitioner) and an extent of Ac. 5.65 cents in Survey Nos.49-2, 51 (3rd petitioner) situated at Vinjaram Village, Polavaram Mandal, Eluru District without following due process of law as arbitrary, illegal, violation of under Articles 14, 21 and 300-A of Constitution of India and against to the well settled principles of natural justice ….” 2. Heard learned counsel for the petitioners and learned Assistant Government Pleader appearing for the respondents. 3. Based on the allegations made in the writ petition, the learned Assistant Government Pleader appearing on behalf of respondent No.5 has placed the written instructions. As per the 4 said instructions, the official respondents have not entered into the lands of the petitioners on 30.11.2025 and the said allegation is absolutely false and the petitioners are not able to file or produce any material to show that the respondent authorities are interfering with the petitioners’ lands. 4. Considering the said submissions, the Writ Petition is disposed of directing the respondents not to interfere and not to dispossess the petitioners from the subject lands without following due process of law. There shall be no order as to costs.
