Since both the petitions arise out of common Crime number for the offence punishable under Sections 80, 85, 115(2), 351(2), 351(3) read with Section 3(5) of the BNS, 2023 and under Section 4 of the Dowry Prohibition Act, 1961, both petitions are clubbed and are heard for passing common
order. 2. These petitions are filed and Section 483 of Bharatiya Nagarika Suraksha Sanhit, 2023 (for short “BNSS-2023”) seeking bail as the petitioners/accused 2 to 5 who are in judicial custody since the date of their arrest, i.e. 11th April
2025. 3. Heard arguments on both sides and perused records. On the basis of complaint filed by Mohammad Jafar Belagaum, Bendegeri Police registered case against accused 1 to 5 in Crime No.44 of 2025 for commission of offence punishable under Sections 80, 85, 115(2), 351(2), 351(3), 352 read with Section 3(5) of BNSS-2023 and Section 4 of Dowry Prohibition Act, 1961. - 4 -

5. It is submitted by the learned Counsel for the Petitioners who are accused No.4 and 5 in Criminal Petition No.101815 of 2025 are the sister of accused No.1 and the husband of accused No.4. It is submitted that they are residing separately at House No.2, 1st Cross, Bidnal, Hubballi and the deceased was residing in Yellapur Oni, M.D. Colony, Hubballi. Petitioners in Criminal Petition No.101818 of 2025 are parents

of accused No.1 and are also residents of Yallapur Oni, M.D. Colony, Hubballi, but residing in a different house. It is submitted that accused have not ill-treated the deceased to bring dowry at any point of time or harassed the deceased physically or mentally. It is submitted that they are falsely implicated in the case. Accused are in industrial custody from the date of their arrest, i.e. 11th April 2025. The accused are not required for any further investigation. 6.
Considering the nature and gravity of offence, the involvement of accused as alleged in the complaint and also considering the fact that the accused are residing in different places, it is just proper to release the accused on bail. Hence, I proceed to pass the following:
O R D E R
1. Criminal petitions are allowed;
2. Petitioners/accused 2, 3, 4 and 5 shall be released on bail on executing a self bond of Rs.1,00,000/- with one surety for the likesum to the satisfaction of the jurisdictional magistrate;

3. Petitioners/accused 2, 3, 4 & 5 shall make themselves available for interrogation by a police officer as and when required;
4. Petitioners/accused 2, 3, 4 & 5 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any Police Officer;
