GP FOR IRRIGATION COMM AREA DEV 3 The Court made the following ORDER: Heard the learned counsel for the petitioners, the learned Assistant Government Pleader for Revenue appearing for the respondent Nos.1 to 4 and the Government Pleader appearing for the respondent No.5. 2. This writ petition is filed questioning the action of the respondent Nos.2 to 4 in making assignments of Gorja (water-course lands) admeasuring an extent of Ac.8.07 cents in S.No.13 situated in Gadempalem Village, Golugonda Mandal, Narsipatnam revenue division, Visakhapatnam District affecting the rights and agricultural operations of the petitioners. 3. On the other hand, the Government Pleader appearing for the respondent No.5 refers to the letter of the 5th respondent addressed to the 4th respondent dated 11.09.2008, stating that, no objection cannot be issued with respect to the subject lands as they are Gorja (water-course lands). As per the Orders of this Court in W.P.No.2493 of 2006, no allotment can be made in respect of the land which forms part of the tank beds and water bodies. By virtue of the interim order dated 23.03.2020, the subject land was not assigned to anyone. 4. In view of the above said facts and circumstances as the respondents’ counsels submits that the subject land is not allotted to anyone as alleged by the petitioners, accordingly, no further orders are necessary in this Writ Petition. However, it is made clear that the respondent authorities concerned shall deal with the subject land in an extent of Ac.8.07 cents in Sy.No.13 of Gadempalem Village, Golugonda Mandal, Narsipatnam revenue division, 4 Visakhapatnam District, strictly in accordance with law, if so warranted for any public purpose. 5. Accordingly, the writ petition is disposed of. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
