Providing Borewell Near ST Colony at Pasarlapadu Village of Rentachintala Mandal, which is illegal, irregular, arbitrary, unconstitutional, against to the Principles of Natural Justice and in violation of Articles 14 and 21 of the Constitution of India, consequently direct the Respondents to pay the total bill amounts of Rs.2,48,619/- (Rupees Two Lakhs Forty Eight Thousand Six Hundred and Nineteen Only) along with interest for the work carried by the Petitioner and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents forthwith to pay the total bill amounts of Rs.2,48,619/- (Rupees Two Lakhs Forty Eight Thousand Six Hundred and Nineteen Only) along with interest in respect of work carried by the Petitioner pending disposal of the Writ Petition and pass Counsel for the Petitioner: 1. GP FOR FINANCE PLANNING 3 The Court made the following order: The grievance of the petitioner is that, the respondent authorities are not paying the contract bill amount of Rs.2,48,619/- for the work executed by him i.e., providing Borewell near ST colony at Pasarlapadu Village of Rentachintala Mandal. 2. When the matter is taken up for consideration today, Ms Chandrika, learned Assistant Government Pleader for Panchayat Raj & Rural Development, while placing on record the written instructions of the Executive Engineer, RWS & S Division, Narasaraopet vide Letter No.SA/CMDF Grant/WP 28063 of 2025 dated 03.11.2025, submitted that the authorities have admitted the bill of the petitioner and they will have to pay an amount of Rs.2,48,830/-, however sought six months time for payment of the said amount. 3. To the said submission, Sri Manikanta Thota, learned counsel for the petitioner, reported no objection regarding payment, but submitted that six months’ time is excessive and prayed to pass appropriate orders in that regard. 4. Perusal of the written instructions of the Executive Engineer, RWS & S Division, Narasaraopet, dated 03.11.2025 indicates that the bill amount has been admitted and the higher authorities have been requested to release the budget, with a prayer to allow six months’ time for payment. 4 5. In view of the facts and circumstances of the case and taking the submissions of learned counsel for the parties into consideration, as the authorities have expressed their intention to pay the bill amount to the petitioner, there is no purpose in keeping this Writ Petition pending. As such, this Court is inclined to dispose of the same, with the consent of both the parties, at the admission stage itself, by passing the following order: “The respondent authorities are directed to release an amount of Rs.2,48,830/- (Rupees Two Lakhs Forty Eight Thousand Eight Hundred and Thirty only) to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. It would be open to the petitioner to agitate his claim for interest, if any, payable by the respondents in an appropriate forum, if so advised.” 6. Accordingly, the Writ petition is disposed of. There shall be no order as to costs.
