Court No. - 5 Case :- WRIT - A No. - 5858 of 2024 Petitioner :- Smt. Prabhawati Mishra @ Prabhawati Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Brahma Nand Pandey,Ram Rasik Tiwari Counsel for Respondent :- C.S.C.,Mritunjay Mohan Sahai,S.M. Mishra Hon'ble Ajay Bhanot,J. By the impugned order the petitioner has been declined the benefit of IInd and IIIrd A.C.P. The impugned order records that the first ACP was granted to the petitioner on 15.02.2023 and the IInd ACP on 15.03.2014. The IIIrd ACP became admissible to the petitioner (after completion of 26 years of service). ACP is admissible only if the service record of the petitioner is satisfactory. The impugned order records that the petitioner's record of service for the relevant period is not satisfactory. The petitioner was granted adverse entries in the year 2015-16, 2016-17 and 2018-19 which were liable to be considered for the purposes of grant of IIIrd ACP. Records of service of the petitioner has been extracted in the impugned order. The pleadings do not disclose any credible challenge to the aforesaid findings as regards lack of satisfactory record of service. No perversity in the aforesaid findings has been shown from the pleadings and the records before this Court. In this wake the Court is unable to come to the conclusion that the petitioner had a satisfactory record of service and possesses the eligibility for grant of IIIrd A.C.P. There is no infirmity in the impugned order since the petitioner did not satisfy the criteria of satisfactory service which is the prerequisite for grant of ACP. The writ petition is dismissed.
