04.04.2025 Item no. 06. Court No.1. S.De Calcutta High Court In the Circuit Bench at Jalpaiguri CRM (A) 168 of 2025 In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023. And In the matter of : Prahhalad Das. ……Petitioner. Mr. Hillol Saha Poddar, ……for the Petitioner. Mr. Nilay Chakraborty, Ld. APP, Mr. Aniruddha Biswas, ……for the State. 1. The petitioner says that he has been falsely implicated. The police has raided his house having been informed that there was narcotic stored in his house. They found no narcotic substance. Instead, they have started this false case saying that a country-made firearm was seized from the backyard of his house. The petitioner prays for anticipatory bail. 2. Learned State advocate shows me the seizure list. It, prima facie, appears that from the backyard of the petitioner’s house, a country-made firearm having total length of 24 inches (approximately) was recovered. This is a serious issue. It may require custodial interrogation. 3. Hence, I am not inclined to grant the petitioner’s prayer for anticipatory bail. 4. CRM (A) 168 of 2025 is dismissed. (Arijit Banerjee, J.)
