This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 12/2025 registered at Police Station Hathband, Distt. Baloda-Bazar-Bhatapara (C.G.) for the offence punishable under Sections 14, 15, of the C.G. Rajya Suraksha Adhiniyam and Sections 25 and 27 of the Arms Act. 2. The earlier bail application of the applicant has been rejected by this Hon’ble Court vide order dated 02.07.2025 passed in MCRC No. 5075 of 2025 on merits. 3. The case of the prosecution in short is that, on 01.02.2025, secret information was received from an informant that a man was carrying a ABHISHEK SHRIVAS Digitally signed by ABHISHEK SHRIVAS Date: 2025.10.15 13:18:11 +0530 2 sharp-edged weapon in his hand and threatening passers-by. Consequently, the police team arrived at the spot, seized the said weapon, and thereafter arrested the applicant. 4. Learned counsel for the applicant submits that this is the second bail application of the applicant, filed on the ground that some of the witnesses have been examined and have not supported the case of the prosecution. He further submits that the applicant has been languishing in jail since 01.02.2025, and as the conclusion of the trial may take some time, he prays for grant of regular bail to the applicant. 5. Learned counsel appearing for the State/non-applicant would oppose the bail application of the applicant. 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the above submissions, as the prosecution witnesses have been turned hostile, the same cannot be a ground for releasing the applicant on bail, which amounts to tempering with the evidence, therefore, I am not inclined to grant regular bail to the present applicant. 8. Accordingly, the second bail application of the applicant - Krishna @ Sonu Chature, involved in Crime No. 12/2025 registered at Police Station Hathband, Distt. Baloda-Bazar-Bhatapara (C.G.) for the offence punishable under Sections 14, 15, of the C.G. Rajya Suraksha Adhiniyam and Sections 25 and 27 of the Arms Act, is rejected. 9. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 10.
