Neutral Citation No. - 2025:AHC:81400 Court No. - 5 Case :- WRIT - A No. - 5856 of 2025 Petitioner :- Smt. Mamta Kashyap Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Abhishek Kumar Saroj,Anil Kumar Saroj Counsel for Respondent :- Abhinava Krishna Srivastava,C.S.C. Hon'ble Ajay Bhanot,J. The petitioner claims family pension of her deceased husband under the New Pension Scheme to which she is lawfully entitled has not been disbursed to her. She has made a representation in this regard but to no avail. The only prayer made by Shri Abhishek Kumar Saroj,
learned counsel for the petitioner is that representation of the petitioner may be decided within a stipulated period of time. Shri Abhinava Krishna Srivastava, learned counsel for the respondent no. 3 and Shri P. K. Shahi, learned Additional Chief Standing Counsel for the State submit that the matter requires determination of facts by the competent authority in light of applicable provisions of law in the first instance. However, they fairly contend that service benefits/claim is liable to be decided by the competent authority in a reasonable time frame. In wake of the aforesaid submissions and without going into the merits of the case, the respondent no. 2 is
directed to decide the representation of the petitioner for disbursal of family pension under the New Pension Scheme in accordance with law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. With the aforesaid direction, the writ petition is finally
disposed of.
