J Crl.P.No.9517ofS025 Dated 13.10.2025 The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.6 on bail in Crime No.03 of 2025 of Chillakur Police Station, Tirupati District, was registered against the Petitioner/Accused No.6 herein for the offences punishable under Section 8 % (c) read with 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances 1985 (for brevity ‘the NDPS Act’) on the allegation of the petitioner/Accused No.6 acted as an organiser and accompanied Accused No.5 in delivering 72 Kgs of ganja. Act 2. Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor. Perused the record. 3. A learned Single Judge of this Court, in Crl.P.No.4937 of 2025 vide order dated 09.05.2025, enlarged Accused Nos.7 and 8 on bail. This Court, in Crl.P.No.6986 of 2025 vide order dated 15.07.2025, enlarged Accused No.5 on bail. The allegation against the petitioner/Accused No.6 is that he acted as an organiser and accompanied Accused No.5 in delivering 72 Kgs of ganja, which is a commercial quantity. The petitioner was arrested on 29.04.2025 and he has been in judicial custody for the past 168 days. This is the second bail application filed by the petitioner. Except for the confession of Accused 3 Or. YLR, J Crl.P.No.9517of2025 Doted 13.10.2025 No.5, no substantial material is available to incriminate the petitioner. The learned counsel for the petitioner submits that the confession of Accused was recorded on 30.04.2025, whereas the petitioner was already arrested and in judicial custody in connection with Crime No. 161 of 2025 of Jangareddigudem Police Station from 29.04.2025 onwards. This Court has granted bail to the petitioner in FIR No. 161 of 2025. No.5 A petition in Crl.P.No.9521 of 2025 seeking the same relief was filed by another Advocate, but the said petition was dismissed as withdrawn today 4. Considering the facts and circumstances of the case, the nature and gravity of allegations levelled against the Petitioner/Accused No.6, this Court is inclined to enlarge the Petitioner/Accused No.6 on bail. 5. In the result, the Criminal Petition is allowed with the following stringent conditions: i. The Petitioner/Accused No.6 shall be enlarged on bail subject to he executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for the like sum each to the satisfaction of the learned I Additional District and Sessions Judge, Nellore. ii. The Petitioner/Accused No.6 shall appear before the Station House Officer concerned, on every Saturday in 4 Dr. YLR, J Crl.P.No.9517of2025 Doted 13.10.2025'' between 10:00 am and 05:00 pm, till filing of the charge sheet. iii. The Petitioner/Accused No.6 shall not leave the limits of the State of Andhra Pradesh without prior permission from the Station House Officer concerned, iv. The Petitioner/Accused No.6 shall not indulge in commission of any offence in future. V. The Petitioner/Accused No.6 shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the dissuade him/her from disclosing such facts to the or to any police officer.
