1. This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 134/2025 registered at Police Station – Kartala, District – Korba (C.G.) for the offences punishable under Sections 316(3) and 61(2) of BNS 2023. 2. As per prosecution story, the complainant lodged an FIR at P.S. Kartala Dist. Korba against applicant and one another accused named Satyendra Tiwari alleging that applicant was working as Project Manager at Agrawal Global Infratech Private Ltd. and Satyendra Tiwari was employed as store incharge and it is alleged in the FIR that VAIBHAV SINGH Digitally signed by VAIBHAV SINGH Date: 2025.10.08 18:52:48 +0530
2 applicant colluded with Satyendra Tiwari and generated fake invoice of Fuel Bill worth Rs. 1334896 in the name of company and the fuel so opted in the name of company was sold in market. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case the applicant was appointed to look over the civil work of the organization and to manage the day-to-day administrative affairs. A copy of the appointment letter is filed herewith and marked as Annexure A/3. The applicant is merely accused of enticement; however, there has never been any conversation or transaction regarding the alleged act. He has been prosecuted solely on the basis that, at the time of the alleged offence, he was serving as the Project Manager of the concerned site. The applicant has not committed any of the essential elements of the offences alleged, nor has he indulged in any fraudulent activity. At no point did the applicant, either in writing or verbally, instruct the store in-charge to generate invoices for procurement of fuel.
The police have falsely implicated the applicant in this case without any valid grounds or supporting documents. The applicant has neither received any amount from any person by deceit, nor assisted anyone in generating fake invoices, nor has he deposited or received any such amount in any bank account or in cash. A copy of the complaint is filed herewith and marked as Annexure A/4. It is further submitted that the applicant has not committed any act constituting the essential ingredients of the alleged offence, and no person has been deceived in any manner. The applicant has been implicated on false and baseless grounds. therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposed the anticipatory bail application of the applicant. 3
5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts and circumstances of the case, the submissions of the learned counsel for the parties, the nature of the dispute, and the material available in the case diary, this Court, without expressing any opinion on the merits, I am inclined to grant anticipatory bail to the present applicant. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant – Binit Pandey, on executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) he shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) he shall appear before the trial Court on each and every date given to him by the said Court till disposal of the trial.
(d) the applicant and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
