IN THE HIGH COURT OF ORISSA AT CUTTACK MATA No.51 of 2021 Smt. Rajeswari Mahakuda …. Appellant Mr. S.K. Dwibedy, Advocate -versus- Sri Pradeep Kumar Mahakuda …. Respondent Mr. L.K. Moharana, Advocate CORAM: JUSTICE B. P. ROUTRAY JUSTICE CHITTARANJAN DASH ORDER 11.02.2025 Order No. 06. 1. Heard Mr. S.K. Dwibedy, learned counsel for the Appellant- Wife and Mr. L.K. Moharana, learned counsel for the Respondent-Husband. 2. Present appeal is directed against the judgment and decree dated 21st September 2020 passed by the learned Judge, Family Court, Berhampur in Civil Proceeding No.07 of 2020. 3. The decree has been granted under Section 13-B of the Hindu Marriage Act upon the application presented by the parties on mutual consent. No objection was raised from the side of either party. Accordingly, learned Family Court granted decree of divorce by dissolving the marriage between the parties. 4. Now the Wife has come up in present appeal alleging that, her signature on the plaint has been taken fraudulently by the Husband and she was unaware of such proceeding of divorce on mutual consent. Upon hearing Mr. S.K. Dwibedy, learned counsel for the Appellant-Wife and going through the appeal memo, we do not find any substance in the contention of the Appellant to deviate from the finding of the learned Judge, Family Court, Berhampur. All such grounds of fraud are seen as mere allegations without any substance and without any supporting material. Thus, we are not inclined to interfere with the impugned judgment and decree. 6. Resultantly, the appeal is dismissed. (B.P. Routray) Judge (Chittaranjan Dash) Judge B.K. Barik Designation: Secretary
