Neutral Citation No. - 2025:AHC:70869 Court No. - 4 Case :- WRIT - A No. - 5961 of 2025 Petitioner :- Rahul Kumar Respondent :- State Of U.P. And 6 Others Counsel for Petitioner :- Kanhaiya Lal Tiwari Counsel for Respondent :- C.S.C.,Pranjal Mehrotra Hon'ble Ajit Kumar,J.
1. Heard Sri Kanhaiya Lal Tiwari, learned counsel for the petitioner, Sri Ravi Prakash Srivastava, learned counsel for the respondent no.7 and Sri Ram Chandra, learned Advocate holding brief of Sri Pranjal Mehrotra, learned counsel for the respondent no.3 as well as learned Standing Counsel for the State.
2. It is contended by learned counsel for the petitioner that the petitioner was engaged on contract basis as Computer Operator-cum-Store Keeper on 24.03.2025 and is aggrieved by the order dated dated 23.04.2025 whereby his contract appointment has come to be rescinded. It is argued by learned counsel for the petitioner that the petitioner ought to have been served atleast with a notice prior to passing the order dated 23.04.2025.
3. Sri Srivastava, learned counsel for the respondent no.7 submits that the answering respondent's contract appointment was wholly and illegally rescinded on 25.02.2025 and a consequential order passed on 20.03.2025. The petitioner thus came to be appointed in his place but as this Court entertained the petition of respondent no.7 being Writ A No.4481 of 2025 with the passing of order dated 26.03.2025 his contract appointment came to be restored and consequently petitioner's contract appointment lost ground to continue and resultantly his contract was liable to be rescinded. Hence, he submits, there is no illegality in the order dated 23.04.2025 inasmuch as the order itself quotes the
stay part of the highcourt's order.
4. Learned counsel for the petitioner could not dispute the fact that appointment of the petitioner was made only for the interregnum period for which the respondent no's.7 appointment remained cancelled. Since the cancellation of appointment of Respondent no.7 has been stayed by this Court vide Writ A No.4481 of 2025, the appropriate order to be passed was to cancel contract appointment of the petitioner.
5. Petition fails and is accordingly, dismissed. Order Date :- 5.5.2025 Deepika Digitally signed by :- DEEPIKA SINGH High Court of Judicature at Allahabad
