1. This writ petition has been filed by the petitioner challenging the legality, validity and proprietary of the impugned rejection slip issued by the respondent No.3 whereby the petitioner has been deprived from the selection on the post of Soldier General Duty (All Arms).

Learned counsel for the petitioner submits that an advertisement (Annexure P/2) was issued by respondent No.2 for appointment on various posts in the Army including the post of Soldier General Duty (All Arms). The petitioner was invited for physical test. However his candidature was rejected by the impugned rejection slip (Annexure ASHISH TIWARI Digitally signed by ASHISH TIWARI Date: 2025.10.09 17:21:53 +0530

Therefore, this writ petition has been filed for setting aside the rejection slip and considering the case of the petitioner for the appointment on the post of Soldier General Duty (All Arms). He submits that for the purpose of recruitment, the candidate ought to have passed 45 marks in aggregate in class 10th and the petitioner is having 45% aggregate in the class 10th examination. Therefore the rejection of the candidature of the petitioner is bad in law. Therefore, this writ petition may be allowed.

Learned Counsel for the respondent Nos.1 to 3 submits that the minimum qualification for appointment on the post of Soldier General Duty (All Arms) is class 10th /Matric pass with 45% aggregate and 33 in each subject. Though the aggregate of the petitioner in class 10th is 45 % however in the mathematics subject he has obtained only 11 marks, therefore his candidature was rightly rejected.

Learned counsel for the respondent No.4 submits that dispute is in between petitioner and respondent No. 1 and 3.
5. I have heard learned counsel for the parties and perused the documents on record.

The educational qualification prescribed for appointment on the post of Soldier General Duty (All Arms) is quoted in Annexure P/2 :- Category (a) Age (Years) (b) Born Between (Both date inclusive) (c) Minimum Physical QR Education QR Soldier General Duty (All Arms) 17 1/2-21 01 Oct 1999 to 01 Apr 2003 Height (CM) (d) Weight (Kg.) (e) Chest (CM) (f) CL 10th /Matric Pass with 45% marks in aggregate and 33% in eachn subject. For Boards follwoing grtading sys Mimn of D Grade (33-20) in Indl subjects or Grade which contains 33% and overall aggregate of C2 Grade. 7. The class 10th mark-sheet cum certificate of the petitioner has been placed on record, according to which he has obtained 11 marks in the mathematics subject. Apart from 45 % aggregate, the candidate ought to have secured minimum 33 marks in each subject. The petitioner has less marks in mathematic subject, therefore the
-3- candidature of the petitioner has rightly been rejected vide rejection slip (Annexure P/1).
8. Accordingly, this writ petition has no merit and it is dismissed accordingly.
9. All the pending applications are also disposed of.
