Mr. J.K. Panda, Advocate -versus-
State of Odisha … Opposite Party Mr. P. Satpathy, Addl. PP
CORAM: JUSTICE G. SATAPATHY
Order No.
ORDER(ORAL)
12.02.2026
02.
1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Boudh P.S. Case No.196 of 2024 corresponding to Special Case No.61 of 2024 pending in the file of learned Sessions Judge-cum-Special Judge, Boudh, for commission of offence punishable U/S.20(b)(c) of NDPS Act, on the allegation of possessing 160Kgs. of contraband Ganja.
3. In course of hearing, Mr. Jugala Kishore Panda
learned counsel for the petitioner submits that the petitioner was neither apprehended from the spot nor was found in conscious possession of contraband article, rather he was implicated in this case falsely and therefore, the petitioner having satisfied the conditions of Section 37 of the NDPS Act, he may kindly be granted bail.
4. On the other hand Mr. P. Satpathy, learned Additional Public Prosecutor by highlighting the
statements of Brundabati Naik and Amit Kumar Panigrahi and other witnesses submits that not only the involvement of the petitioner in this case is palpable from the statement of the witness Jasobanta Bhoi, but also the quantity of Contraband Ganja recovered in this case is above the commercial quantity and since the petitioner has not satisfied the condition of Section 37 of the NDPS Act, his bail application may kindly be rejected.
5. After having considered the rival submissions and taking into consideration the nature and gravity of the offence as alleged against the petitioner vis-à-vis the accusations sought to be brought against him and regard being had to the recovery of Contraband Ganja weighing 160Kgs which is coming under the commercial quantity and taking into account the statement of witness so referred to by learned Addl. PP and keeping in view the failure of the petitioner to satisfy the conditions of Sec. 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner.
6. Hence, the bail application of the petitioner stands rejected. Accordingly, the BLAPL stands
disposed of. A copy of this order be immediately transmitted to the learned Court in seisin over the matter, who shall communicate the same to the concerned Jail for reference.
