GP FOR HOME The Court made the following: THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA WRIT PETITION NO: 33742 of 2025 ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “…pleased to issue an order or a direction or a writ. more particularly one in the nature of Writ of Mandamus declaring the action of the Respondent Nos. 3 and 4 in not taking any action against the unofficial respondent Nos. 5 and 6 upon the complaints made by the Petitioner on dated 25.11.2025 and in not registering the crime against the unofficial respondnet Nos. 5 and 6 herein as illegal, arbitrary and unconstitutional, and to consequently direct the Respondent Nos. 3 and 4 to register the crime against the unofficial respondent No. 5 and 6, and to pass.…” 2. Heard learned counsel for the petitioner and Sri V. Farook, learned Assistant Government Pleader for Home appearing for respondents 1 to 4. 3. Learned Assistant Government Pleader for Home, on written instructions, would submit that a case and counter case are registered against the petitioner and the unofficial respondents. Based on the complaint made by respondent No.5, a case in Cr.No.450 of 2025 for the offences punishable under Sections 318(4), 115(2), 74, 351(2) r/w 3(5) BNS, was registered against the petitioner. A counter case was registered, based on the complaint made by the petitioner in Cr.No.474 of 2025 for the offence punishable under Sections 329(4), 115(2), 79, 351(2) r/w 3(5) BNS against the respondents 5 & 6. 4. Learned counsel for the petitioner would submit that recording the same, the petition may be disposed of. 5. Recording the above said submission, this Writ Petition is disposed of. However, the police are directed to follow the due process of law regarding the crimes which have been registered. No order as to costs.
