Heard the parties.
The petitioner has been made accused in connection with Hunterganj P.S. Case No. 157/2023, corresponding to N.D.P.S. Case No.04 of 2024, registered under Sections 15 (c), 27(a) and 29 of the N.D.P.S. Act, pending in the Court of learned Additional Sessions Judge-II, Chatra. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 6072 of 2024 by order dated 28.08.2024. The petitioner is a driver of a Scorpio bearing registration no. JH-13- F-9486, which was seized by Hunterganj police during the intervening period of 12/13.08.2023. On search, 128 kgs. of Doda were recovered from the said vehicle.
Learned counsel appearing on behalf of the petitioner submitted that petitioner is in custody since 14.08.2023. It was further submitted that similarly situated co-accused persons have been granted bail by a Co- ordinate Bench of this Court.
Considering the fact that commercial quantity of Doda was recovered from the possession the petitioner, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected.
Learned trial court shall expedite the trial.
