By order dated 24.12.2025, the suit was decreed in favour of the Plaintiff and against the Defendants in terms of paragraph 49(i), (ii), (iii) and (iv) of the plaint and Defendants No. 1 to 3 were directed to file an affidavit of undertaking within one week. Affidavit has been filed by the Defendants and is on record. The only controversy that remained was with regard to damages. Learned counsel for the Plaintiff candidly, on instructions, submits that Plaintiff does not wish to press the claim for damages, however, insists that some cost be imposed on the Defendants as it is the action of the Defendants, which has compelled the Plaintiff to approach this Court. 2. Accordingly, with the consent of the parties, it is directed that Defendants shall pay a nominal cost of Rs. 50,000/- to the Plaintiff within one week from today. 3. Suit is disposed of.
