The present applicant ‘Sunil Kumar’ is praying for regular bail in relation to First Information Report dated 18.06.2024 bearing FIR No. 0101 of 2024 P.S. Pithoragarh, District Pithoragarh, wherein, the present applicant has been implicated for the offence punishable under Section 376 of IPC. 4. Learned counsel for the applicant submits that after investigation the chargesheet has been filed, therefore, there is no need of custodial interrogation. 5. Apart from this, he submits that the applicant was in love with the victim and the physical relations was consensual. 6. Apart from this, he submits that only on the basis of false pretext of marriage the FIR has been lodged. 7. On the other side, learned A.G.A. submits that the victim supports the case of the prosecution in her statement under Section 164 of Cr.P.C. 8. After hearing the learned counsel for the parties, this court is of the view that the applicant does not deserve for bail. Accordingly, the bail application is rejected.
