Sri V. Ch. Naidu, learned standing counsel for APEWIDC assisted by Sri L. Radha Krishna, learned counsel had passed on a tabular statement of amounts payable to the Petitioners in all these cases and further submitted that there is no legal bar for payment of retirement benefits to the Petitioners and the amounts are not being paid for want of funds to the Respondent- Corporation, which are held up on account of various reasons. 3. It was further submitted by learned standing counsel that this Court had passed orders in various other similar cases, and 69 Contempt Cases are pending at the behest of Respondent-Corporation and the Respondent- Corporation is trying its best to pay the amounts. The payment of retirement benefits is a statutory obligation, and also timely payment of retirement benefits would enable the individuals to lead a dignified life in the last quarter of life. The delay in payment of retirement benefits cannot be sustained on the ground of lack of funds from Respondent- Corporation. 6. Therefore, these writ petitions are disposed of with the following directions:- (i) The Respondents shall pay statutory rate of interest for delayed payments as regards gratuity i.e., from the date of entitlement of interest till the date of payment. (ii) The Respondents are directed to make payment at the rate of 6% interest for delayed payment towards non-statutory heads 67 of retirement dues to the Petitioners from the date of entitlement of dues till actual payment. (iii) The admitted retirement amounts to the Petitioners shall be disbursed within a period of four (04) months from the date of receipt of a copy of this order. (iv) There shall be no order as to costs.
