WRIT PETITION NO.30516 OF 2023
ORDER:-
1. This writ petition is filed under Article 226 of the Constitution of India claiming the following relief:
“To issue Writ Mandamus Declaring the action of the respondents 2 to 9 in not implementing the orders 3rd respondent made in Revision Petition vide D.Dis.D4/9419/2012 dated 27052016 as well as the judgment and decree passed by the learned Senior Civil Judge Srikalahasti vide OS No 193/2015 dated 10.03.2023 issued in favour of the Petitioner and inspite of the same interfering with the peaceful possession and enjoyment of the land of the Petitioner by leveling the agricultural land for the purpose of making residential plots without following procedure at the behest of the respondents 10 and 11 is arbitrary unreasonable and consequently direct the respondents not to interfere with the peaceful possession of the agricultural land of the Petitioner to an extent of Ac.0-14 cents in Sy.No.288/2A an extent of Ac.0-05 cents in Sy.No.290/3 an extent of Ac.0-21 cents in Sy.No.290/4 an extent of Ac.0-28 cents in Sy.No.290/7 an extent of Ac.0-15 cents in Sy.No.290/8A and an extent of Ac.0-25 cents in Sy.No.290/9 totaling an extent of Ac.1-08 cents of Panagal Village Srikalahasti Mandal of erstwhile Chittoor District at present Tirupati District without following due process of law”

During hearing, learned counsel for the petitioner submits that, the petitioner purchased an extent of Ac.1-08 cents of agricultural land in favour survey numbers of Panagal village, Srikalahasthi Mandal, Tirupati District from her original owner – Smt. Gaddam Chengamma through registered Sale Deed vide Document No.1171/2006 dated 13.02.2006. 2
While so, the respondents are interfering with the property of the petitioner. Hence the writ petition. 3. On the other hand, learned counsel for the respondents filed counter affidavit(s), and submits that the respondents are not interfering with the peaceful possession and enjoyment of the property of the petitioner and they are in possession and enjoyment of their own property which was acquired by the original owner M. Mangamma. 4.
In view of the clear and categorical statement made by learned counsel for the respondents, since the respondents are not interfering with the peaceful possession and enjoyment of the petitioner, the claim of the petitioner that the respondents are interfering with the property of the petitioner is not made out, as such, no further orders are necessary to be passed in this writ petition. 5. Accordingly, the writ petition is closed. No costs. 6.
